CBS won a round in its battle with against the ex-“Survivor” castoff Stacy Stillman – and can proceed with its breach-of-contract suit.

CBS and the Survivor Entertainment Group (SEG) claim Stillman breached her “Survivor” confidentiality agreement by claiming the show is rigged and suing SEG, CBS and “Survivor” producer Mark Burnett.

In her lawsuit, Stillman claims Burnett prodded two “Survivor” contestants to vote Stillman off and keep grizzled ex-Navy SEAL Rudy Boesch on the show.

According to Inside.com, Stillman filed a special motion to have the SEG suit stricken as a violation of California’s anti-SLAPP (Strategic Lawsuits Against Public Participation) law, which prohibits lawsuits that attempt to quash the free-speech rights of others.

But, as Inside.com reports, Los Angeles Superior Court Judge Ralph Dau said that he could not dismiss the lawsuit against Stillman because SEG has met its burden of proving that there is a possibility that Stillman defamed the company in statements made in interviews with the press.-
