A plea deal that could have sent husband of “Real Housewives of New Jersey” star Teresa Giudice to jail for up to five years fell apart yesterday.

Joe Giudice yesterday pleaded not guilty to charges he used his brother’s ID to obtain a driver’s license after his had been suspended.

The plea signaled that negotiations over a plea deal with the Passaic County DA had broken down. The offer of no more than five years was rejected as too harsh, according to Giudice’s lawyer.

“I believe that because of Joe’s celebrity he is being treated differently,” the lawyer told the Bergen Record newspaper.
