WASHINGTON — Lawyers say they will not appeal a judge’s order to share interview notes with Roger Clemens’ defense team, clearing the way to start the former pitching star’s criminal trial on July 6.

With the decision not to appeal, investigators who worked on the Mitchell Report on performance-enhancing drugs in Major League Baseball agreed to turn over notes they took when they interviewed two of Clemens’ accusers.

U.S. District Judge Reggie Walton says Clemens needs the material to defend himself against charges he lied when he denied using performance-enhancing drugs.

The Mitchell Report investigators took the notes in their questioning of steroids dealer Kirk Radomski and longtime Clemens trainer Brian McNamee. Both said they provided drugs for the seven-time Cy Young winner. Clemens denies it.
