Trainer Rick Dutrow Jr., banned for 10 years last week by the New York State Racing and Wagering Board effective this Tuesday, was granted a 30-day stay of that penalty on Monday by New York State Supreme Court judge Richard Giardino at a hearing in Schenectady.

Dutrow, whom the SRWB labeled a person “detrimental to the best interests of racing’’ based on a long history of violations, will be allowed to continue to train his horses until his appeal is heard.

“We’re very satisfied with the judge’s decision,” Dutrow’s attorney, Michael Koenig, told Daily Racing Form. “We are satisfied that we received 30 days because Rick Dutrow is not looking to delay a resolution to this case. We are ready to move forward, we just want to make sure we have a fair and meaningful opportunity to do so. That’s why we are very comfortable saying we can do this within 30 days. We’re comfortable with the case, we’re comfortable with the facts, and we look forward to bringing to this to the courts.’’

Koening, arguing that Dutrow’s right to due process has been violated, will base his appeal on what he calls a “conflict of interest” involving John Sabini, chairman of the SRWB. Sabini is also secretary/chair-elect of the Racing Commissioners International, which originally sent a letter to the SRWB urging that Dutrow’s license be revoked.
