BALTIMORE – Stewart Elliott, the jockey of Smarty Jones, was fined $1,000 yesterday by the Kentucky Horse Racing Authority for failing to note he pleaded guilty in 2001 to criminal assault in New Jersey when he applied for his license to ride in the Derby.

The fine was handed down for “violation of (rule) 810KAR 1:025, section 3, subsection 3. Falsification, misrepresentation, or omission of required information in a license application.”

“You make the mistake, you pay the penalty,” said Elliott’s agent, Ray Lopez. “It’s behind us now.”
