EVANSVILLE, Ind. — Three-time Kentucky Derby winning jockey Calvin Borel will face court Monday on a preliminary charge of driving while intoxicated, following his weekend arrest in Evansville, Ind.

Borel, 44, was arrested by Indiana State Police shortly before midnight Saturday local time after officers allegedly noticed him making an unsafe lane change, the Evansville Courier and Press reported.

Borel’s agent Jerry Hissam said his blood alcohol level was “barely over” the legal limit of 0.08 percent, ESPN reported.

He was released on $100 bond Sunday morning.

Borel won the Kentucky Derby with Street Sense in 2007, Mine That Bird in 2009 and Super Saver in 2010.
