Celebrity dentist Dr. Jonathan B. Levine has brushed off a legal effort to block his new line of teeth-whitening products.

A federal judge in Manhattan ruled this week that “Go Smile” — a teeth-whitening brand Levine co-founded eight years ago — is unlikely to make a convincing case that Levine’s new “Glo” line of products infringes on its trademark.

“Go Smile” has harped on the similarity between the words “Go” and “Glo,” which didn’t escape the judge’s notice.

“Indeed, the two single-syllable words begin with a common hard-g sound followed by a long-o sound,” Judge P. Kevin Castel wrote.

But in a consumer survey submitted as testimony, “actual evidence of confusion” among shoppers was “to put it charitably, weak,” the judge ruled in denying Go Smile’s request for a preliminary injunction against Levine’s Glo products.

Go Smile was “surprised and disappointed” by the ruling and thinks “there are strong grounds” to appeal, although it’s still evaluating options, an attorney for the company said.
