“Pharma bro” Martin Shkreli remains in a Pennsylvania prison, but his prosecutor and his lawyer were in a Manhattan appellate courtroom Friday clashing over his claim that his securities-fraud conviction should be voided because his jury was “confused.”
During contentious arguments before a three-judge Appellate Division panel, Shkreli’s appeals lawyer, Mark Baker, said jurors were obviously confused during deliberations, when they asked to have the legal concept of “fraudulent intent” explained to them. Prosecutor Alixandra Smith insisted the jury was properly instructed.
Shkreli was sentenced to seven years’ prison in 2018.
