San Francisco-based Twitter told a Chicago judge on Monday that the Windy City is the wrong place for a court battle between it and Los Angeles-based Herbalife.
Herbalife sued the micro-blogging site, headed by Chief Executive Jack Dorsey, on July 20 seeking to unmask an anonymous tweeter — named “AfueraHerbaLIES,” which roughly translated from Spanish means “out with Herbalife.”
It has posted 2,687 tweets this year attacking the company as a fraud that exploits Hispanics.
The controversial diet-shake company, which denies the allegations, said it wanted to find the person behind the account so it could sue for defamation.
In a five-minute hearing, Twitter lawyer Brian Sher said the case needs to be filed in California.
Herbalife did not return a call for comment.
