But happy they are after back-to-back legal victories that go a long way toward establishing that both artists and labels are entitled to publishing royalties for pre-1972 recordings.

The loser in each case is SiriusXM, which has never paid for playing the vintage songs.

Its argument: The songs were authored before federal copyright law began protecting recorded music.

However, a California judge, completely reversing a tentative finding in August, ruled Monday that pre-1972 songs will be covered by state law.

Judge Mary Strobel said she was swayed by a September federal court ruling that SiriusXM and other music-streaming services violated The Turtles, aka Flo and Eddie, and other songwriters by playing the music without the artists’ approval.
