A judge has tossed out a defamation lawsuit brought on by the businessman shown in the movie “Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan” as he is chased down Manhattan’s Fifth Avenue by Sacha Baron Cohen’s phony Kazakhstan journalist character, Borat.

In the movie, Jeffrey Lemerond is shown running and yelling “Go away!” as Cohen/Borat chases him in an attempt to hug strangers.

The judge applied the term “newsworthy” to the 2006 hit movie, saying it employs a brand of humor that appeals to the most childish and vulgar in its viewers, but that it also attempts an ironic commentary.
