A medical examiner in the murder trial of a Florida man who claims his girlfriend choked to death performing oral sex says that he has never come across such a case.

Richard Patterson, 65, of Margate, was on trial Thursday for second-degree murder in the 2015 death of 60-year-old Francisca Marquinez.

His lawyers have argued that she died accidentally in the throes of passion, but associate Broward County medical examiner Iouri Boiko questioned the defense’s theory. Boiko, who performed Marquinez’s autopsy, testified Thursday that her airway would have had to have been blocked for two to three minutes.

“I don’t think it’s possible,” said Boiko, according to the Sun Sentinel.

He said there would have been a clear sign of struggle.

“If she cannot breathe, she usually start to kicking, biting or to do something to prevent this blocking of the airway, try to open this airway,” said Boiko. “It’s (a) normal reaction of any person.”

Patterson’s lawyers have filed a motion to show his penis as evidence to the jury, but the judge has not ruled whether his member will be on display in court. While the prosecution reportedly does not object, there was disagreement about if he would need to be erect.

If convicted, Patterson could face life in prison.
