A woman who is desperate to get out of her 40-year marriage isn’t allowed to divorce her husband just because she’s unhappy, a court has ruled.

Tini Owens, 68, must stay married to her husband Hugh – who is refusing to agree with a divorce – until 2020, BBC News reported.

A panel of Supreme Court judges in London unanimously agreed Wednesday that Tini didn’t have the grounds to divorce Hugh, with one jurist saying Parliament had “decreed” that being in a “wretchedly unhappy marriage” wasn’t a good enough excuse to legally split.

The UK has stringent laws that only allow divorce if a person can prove the marriage has fallen apart because of adultery, unreasonable behavior or desertion. Otherwise, both parties must have lived apart for two years and agree to the divorce or, if they disagree about splitting, have lived apart for at least five years.

In Tini’s case, she said she weighed divorce since 2012 but didn’t move out until February 2015.

Now, she’ll have to wait another two years in order to officially split from Hugh, 80.

In her initial divorce proceeding, Tini lodged 27 allegations about the way Hugh mistreated her, including speaking to her in an “insensitive” way and constantly mistrusting her, the BBC reported last year.

“The simple fact is that I have been desperately unhappy in our marriage for many years,” she said in court documents. “There is no prospect of reconciliation.”

Hugh denied her claims, blaming their unhappy union on her. He accused her of having had an affair and being “bored.”

Tini has been waging legal war against her husband since 2016, when a family court judge refused to grant her divorce. She appealed but lost.

Hugh’s lawyer said the Supreme Court got it right because Tini “was essentially advocating divorce by unilateral demand.”

Her lawyers said she shouldn’t have had to prove that Hugh’s behavior was “unreasonable” – and asked for a “modest shift” in interpreting the law.

The couple married in 1978 and have two children. They lived together in Worcester.
