Cops stopped 61-year- old Dana Seaman for driving erratically, and he agreed to be tested.

While the officers were getting ready, one of them spotted him drinking from a cup and then tossing it under the passenger seat.

Cops retrieved the cup, which they said smelled strongly of alcohol.
