Chad Harbach has prevailed in a suit accusing the best-selling author of cribbing parts of “The Art of Fielding” from an unpublished college baseball novel.

The case was dismissed by Judge Alvin Hellerstein of US District Court in Manhattan on Monday on grounds that “none of the plaintiff’s allegations of substantial similarity hold up.”

Plaintiff Charlie Green, who now runs a chain of pizzerias in Texas, filed the complaint in September, alleging that Harbach’s best-selling 2011 book lifted key scenes and plot twists from his “Bucky’s 9th.”

The story by Green made the rounds in New York’s literary circles as a screenplay and then a novel from the mid-1990s to the late-2000s.

Green said was “greatly disappointed with the result” and intends to appeal.
