A story in The New Yorker alleging sexual misconduct by CBS chief Les Moonves and other company executives has generated its first lawsuit.

Shareholder Gene Samit charged in Manhattan federal court on Monday that claims in the magazine from a half-dozen women fly in the face of “positive representations” in CBS’ public filings.

Those representations failed to disclose that CBS execs “had engaged in widespread workplace sexual harassment.”

The filing continued, “As a result, CBS’s public statements were materially false and misleading.”

The action specifically cites a 6.1 percent decline in CBS’ stock on July 27 after speculation surfaced over the story, which was written by Ronan Farrow and appeared in the issue dated Aug. 6 to Aug. 13.

CBS’ stock closed Monday at $53.66 per share, up 1.1 percent.
