Assault charges against former New York Yankee Pat Kelly and his gal pal were dismissed Wednesday.

Neither the retired infielder nor his flame, Marina Cernova, were in court as prosecutors said the couple refused to cooperate with authorities and asked a Manhattan judge to toss and seal the case.

The duo were busted in October following a spat at the tony London Hotel in Midtown, where sources said Cernova punched Kelly in the face.

Cernova first called cops on the ex-Yankee for allegedly grabbing her by the wrists and pushing her out of their hotel room, according to court records –but was cuffed after the 49-year-old claimed she’d repeatedly slugged him.

Both were arrested on misdemeanor assault charges.
