A judge ruled in Michael Irvin’s favor again amid the Pro Football Hall of Famer’s $100 million lawsuit against hotel chain Marriott International.
Irvin counter-sued the hotel for defamation after an unnamed female employee accused him of alleged misconduct during a Feb. 5 interaction in the lobby of a Phoenix Marriott — and later filed a second motion for the hotel to release any video footage it has of the incident, which was granted by a judge.
Marriott then filed a motion asking a federal judge to dismiss Irvin’s $100 million defamation lawsuit and Tuesday asked a judge to deny Irvin’s request for expedited release of hotel video footage.
On Wednesday, a second district judge ordered Marriott to release the items and documents sought in Irvin’s request no later than Tuesday at 5 p.m.
“Marriott’s limited participation in court-ordered discovery does not demonstrate its intent to litigate the underlying merits of the case in this Court,” court documents, obtained by USA TODAY Sports, state. “Nor is there any risk that expedited discovery will cause wasted effort here because the footage and documents sought by Plaintiff will undoubtedly be discoverable and highly relevant irrespective of whether this case is litigated in this Court, in the District of Arizona, or elsewhere.”

Getty ImagesIn the court documents, Marriott argued that Irvin’s urgency for the release of the items isn’t legitimate — and said the former Cowboys receiver is “litigating in the court of public opinion in an effort to convince the NFL to let him cover the NFL Combine” this week in Indianapolis.
“Plaintiff hopes to obtain the footage so that he can fashion a narrative, feed his propaganda machine, and improperly invite potential jurors to prejudge this matter in his favor,” Marriott said in the legal papers. “The assertion is smoke without fire.”

Icon Sportswire via Getty ImagesThe judge also ruled that Marriott can protect the identity of Irvin’s accuser, and said the hotel’s concern for her privacy “is well-founded,” according to TMZ.
Irvin’s attorney, Levi McCathern, said he and his client are “pleased” with the ruling.
“Michael and I are pleased with the ruling, and we thank the Court for ruling so quickly and equitably,” McCathern told the outlet. “We look forward to receiving the information that we believe will prove that Michael was engaged in no wrongdoing.”
Irvin was removed from NFL Network’s Super Bowl coverage after news of the incident was made public, and has been absent from his usual Monday appearances on ESPN’s “First Take.”

Getty ImagesThe 56-year-old Irvin is reportedly accused of making “harassing and inappropriate” comments to an unnamed female employee, described as “Jane Doe” in his $100 million lawsuit against the hotel.
The woman’s allegations against Irvin have not been disclosed by the hotel.
At the time, Irvin said he returned from having dinner and a few drinks with former Cowboy Michael Brooks — and told The Dallas Morning News that there “absolutely was no sexual wrongdoing,” and that he engaged in a “45-second conversation” with the woman.
In his lawsuit, Irvin’s attorney said that the interaction between Irvin and the employee lasted less than a minute, and that afterward, his client went to his hotel room alone and fell asleep.

Getty ImagesIrvin accused the hotel’s management and its employees of making him the victim of “cancel culture,” and alleged he’s being “railroaded” with false accusations.
Additionally, Irvin accused the hotel’s manager of reporting the alleged incident to the NFL “with the intention of damaging that relationship and canceling [Irvin].”
McCathern previously told TMZ that his client’s reputation has been damaged and that Irvin has lost out on money and canceled appearances as a result of the false allegations.
