First ailing media mogul Sumner Redstone kicked his ex-girlfriend out of his Beverly Hills home, now a Manhattan judge has booted her from his New York penthouse in the Hotel Carlyle.

Manhattan Supreme Court Justice Erika Edwards also denied the request by the woman, Manuela Herzer, to take a mental exam of the 94-year-old Viacom founder to determine if he was fit enough to sue her for the $3.75 million pad last year.

Redstone purchased the East 76th Street apartment in March 2015, promising to give it to his then-partner when he died, according to his Manhattan Supreme Court suit.

After they split he decided he no longer wanted to leave the property to Herzer, but she refused to give up her rights to it.

Now Judge Edwards has ordered the Hotel Carlyle Owners Corporation to strike Herzer’s from the proprietary lease.

Edwards ruled in a decision released Wednesday that Herzer has “no valid ownership claim to the apartment” based on an agreement she signed with Redstone in Jan. 2015.

The contract said Herzer may inherit the pad, but Redstone was not gifting it to her before she died.

“The terms of the agreement are clear and unambiguous and the agreement expressly sets for the parties’ intent,” the judge writes.

She adds that “Redstone paid all the money to purchase and maintain the apartment. He paid the purchase price, closing costs, renovations and redecorations of the apartment and all of the monthly maintenance and assessment fees. Additionally, the closing documents for the purchase of the apartment were solely in his name.”

The judge said a mental exam of Redstone wasn’t necessary because she was basing her ruling on the four corners of the 2015 agreement, which Herzer herself signed.

Reps for the two sides did not immediately return messages seeking comment.
