An Ohio man donning a “Beavis and Butthead” T-shirt was busted for throwing a sex toy from the bleachers at a New York Liberty game – hitting a 12-year-old girl in the leg, cops said.
Charles Burgess, 32, of Dayton, surrendered Wednesday morning at Brooklyn’s 78th Precinct – which covers the area of the Barclays Center, where he allegedly threw the lime green dildo around 8:45 p.m. Aug. 5, police said.
Prosecutors say Burgess pulled the sex toy out of his pants pocket and flung it toward the court, striking the pre-teen spectator in its path.
Charles Burgess was was arrested for throwing a sex toy from the bleachers at a New York Liberty game. DCPIThe girl suffered “substantial pain,” feared further injury and became “alarmed and annoyed,” according to a complaint filed in Brooklyn Criminal Court.
Burgess was arraigned on multiple charges, including attempted assault in the second and third degrees, third-degree assault, second-degree menacing, second-degree reckless endangerment, third-degree obscenity, fourth degree criminal possession of a weapon, interference with a professional sporting event and second-degree harassment, the complaint said.
Burgess was released on his own recognizance during his arraignment later in the day, prosecutors said.
Burgess’ attorney, Paul D’Emilia, told The Post in a statement that his client “voluntarily surrendered” after driving himself to the Big Apple overnight from Ohio, where he owns an auto body shop.
In another incident the same day, Indiana Fever star Sophie Cunningham was directly hit by a green dildo during a game against the Los Angeles Sparks. KPIX/XHis mother and aunt accompanied him when he turned himself in, D’Emilia said.
D’Emilia described his client as a married father with six children, who has “absolutely no criminal record.”
“He does not regularly attend WNBA games, he is a casual fan, and he is not involved in any of these or prior incidents,” the lawyer said.
“Mr. Burgess intends to vigorously fight these embellished and exaggerated charges.”
D’Emilia also contended that “video evidence” reveals that “no one was actually struck by the thrown object rendering any of the included assault charges unsustainable.”
“The Brooklyn DA’s office has indicated a desire to speak to the defense, particularly in regards to others involvement in this fast-spreading phenomenon occurring at WNBA venues,” he added.
Burgess is due back in court on Dec. 15, online records show.
