A convicted Russian arms dealer dubbed “The Merchant of Death” won’t be getting a new trial, an appeals court ruled Monday.

Viktor Bout, 49, who is serving a 25-year sentence for selling 100 surface-to-air missiles to a Colombian terrorist group, argued for a new trial over statements made in the documentary “The Notorious Mr. Bout,” which was filmed after his 2011 Manhattan federal-court trial.

The film, Bout’s lawyers argued, shows that star witness Andrew Smulian was a government informant, and that Bout could not have conspired with him.

But judges with the 2nd Circuit appeals court said that while that information is “new,” they sided with a lower-court judge in finding that it would not have affected the verdict.

This is the second time Bout has unsuccessfully appealed his conviction.
