California’s Attorney General is fighting to free a woman who was charged with murder after her stillborn baby had a high level of meth — accusing fellow prosecutors of twisting laws meant to protect women.

Chelsea Cheyenne Becker, 26, has been in custody on $5 million bail since Nov. 10 after the Kings County District Attorney said her drug use caused the death of the child on Sept. 10 last year.

Attorney General Xavier Becerra on Friday filed an amicus brief — a legal interjection from someone not directly involved in the case — to support Becker’s appeal after it was rejected in superior court in June.

Becerra said that the law being used against her was “intended to protect pregnant women from harm, not charge them with murder” and insisting the laws were “misapplied and misinterpreted.”

“Our laws in California do not convict women who suffer the loss of their pregnancy, and in our filing today we are making clear that this law has been misused to the detriment of women, children, and families,” he said in a statement.

“We will work to end the prosecution and imprisonment of Ms. Becker so we can focus on applying this law to those who put the lives of pregnant women in danger.”

Kings County District Attorney Keith Fagundes told CNN that his office was caught by surprise and was not warned about the Attorney General’s interjection.

“This case is not about a stillbirth, it is a case about a mother’s overdose of a late-term viable fetus,” Fagundes told the network.

“I appreciate the Attorney General’s opinion, and can only conclude that he has not been properly briefed on the facts of this case, has not read any police report nor has he reviewed the medical information involved in this particular case.”
