An ex-San Jose State University women’s volleyball assistant coach alleges she was fired for filing a Title IX complaint about a transgender player on the team — who allegedly conspired to hurt a teammate and vocal critic of trans athletes in women’s sports, a new lawsuit claims.

The former staffer, Melissa Batie-Smoose, claims she was initially suspended late last year and then later terminated from her coaching gig as “direct retaliation” for raising her concerns about sex discrimination, the suit filed last week states.

“Punishing coaches for raising concerns about the fairness and integrity of women’s sports not only harms the individual advocate but also undermines the enforcement of Title IX’s mandate and has a chilling effect on those who seek to protect sex equality in collegiate athletics, contrary to public policy and the statutory objectives of Title IX,” the court filing charges.

“[The school’s] actions in suspending and terminating [Batie-Smoose] were not based on her job performance but were in direct retaliation for her opposition to sex discrimination and her advocacy for the fairness and equal access to programs, services, and activities for female athletes.”

The controversy surrounding San Jose State first erupted last season when it emerged that a transgender player, Blaire Fleming, was on the team’s roster — resulting in some opposing teams forfeiting games and a flurry of legal action.

In Batie-Smoose’s original Title IX complaint, which was filed last October, the assistant coach alleged the university had shown favoritism toward Fleming over other players and had withheld knowledge about the athlete’s birth gender.

The complaint also included claims that Fleming had allegedly plotted to have her teammate, Brooke Slusser, spiked in the face during one game because the latter had been a vocal critic of the trans player’s involvement on the team.  

Batie-Smoose’s latest lawsuit — filed against the Board of Trustees of the California State University, which oversees SJSU — alleges she was suspended shortly after lodging the complaint.

Her employment was terminated in January when the school declined to renew her contract, the filing states.

In the wake of the controversy, the assistant coach told Fox News that she has struggled to land a new coaching job.

“I’ve been a very successful coach and I’ve coached for a long time and I’m not even getting any looks for any coaching jobs,” Batie-Smoose said after relocating from California to Texas. 

Batie-Smoose’s suit is seeking compensatory damages, reinstatement and back pay in the wake of her termination.

The lawsuit also seeks injunctive relief that ensures biologically born female athletes won’t have to compete with or against transgender athletes. 

San Jose State didn’t respond to The Post’s request for comment.
