The family of a Muslim man whose body underwent an autopsy in violation of his religion after he was killed in a 2008 Bronx car crash can sue the city, a judicial panel ruled Tuesday.

The city had argued to a Manhattan court that it had no “special duty” to let the family of Darden Binakaj know his body was at the Medical Examiner’s Office.

The judges disagreed, noting that cops bungled their own procedures to identify his next of kin.
