A Texas man shot by a witness who spotted him stabbing his 16-month-old son in a courtyard was indicted for the heartless murder, prosecutors said.
Blair Ness, who was shot in the leg by one of his neighbors during the Aug. 19 attack, was indicted on a capital murder charge Thursday in the toddler’s death, which occurred in front of several witnesses at the Oak Forest Apartments in Lewisville, the Dallas Morning News reports.
If convicted, Ness faces life in prison without the possibility of parole.
The boy, Ashton Ness, died from multiple blunt-force and sharp-force injuries, a medical examiner found.
Edward Carranza, who lived at the apartment complex with his wife, told The Post in August that he was sleeping when he heard several people screaming outside. He then heard three or four gunshots and went outside, where he saw Ness holding his son while standing in a “big pool of blood,” Carranza said.
“He had an evil look,” Carranza told The Post. “The look that he had in his eyes was not a normal look.”
Carranza said Ness then tossed his son onto the concrete before stabbing him several times with knives and a pair of scissors. The gruesome attack ended when another neighbor opened fire on Ness, striking him in the leg, Carranza said.
“He was trying to get people to come toward him,” Carranza said. “He was screaming, ‘Come on, come out here’ again and again to try to get people to come see what he was doing.”
Police also said another witness reported that Ness yelled “Jesus is coming” prior to the fatal attack.
Investigators believe the attack actually started inside Ness’ apartment, where he lived with his son and the boy’s mother, Alexandra Murphy, who was at work during the attack, according to the Dallas Morning News.
“I know everyone’s mad, I’m mad,” Ness told police as he was taken into custody, according to an arrest affidavit. “I killed my son.”
Ness remains held in Denton County in lieu of $1.5 million bail, the Morning News reports.
