The US Supreme Court has agreed to review the constitutionality of the gun law used to convict Hunter Biden.

The former first son was convicted last summer of illegally owning a gun while hooked on drugs — but he received a pardon from his father, former President Joe Biden, before he left office.

Now, the high court will hear the case of Ali Hemani — who was charged under the same law of illegally owning a pistol after cops found the firearm with other drugs at his Texas home during a search in 2022.

The question is whether the law is a violation of the Second Amendment right to bear arms.

Despite the fact that the Trump Administration has been a proponent of gun rights, it is asking the Supreme Court to reinstate the case against Hemani and wants the court to broadly find that regular drug users and addicts shouldn’t be allowed to own firearms — even if they weren’t intoxicated at the time, according to a report by Politico.

The Fifth Circuit Court of Appeals threw out Hemani’s case on the grounds he wasn’t under the influence when cops searched his place and found the gun — even though he admitted to regularly smoking pot.

Hunter Biden was convicted by a Delaware federal jury in June 2024 after he knowingly lied on a gun application form, saying he didn’t use controlled substances when he bought the firearm on Oct. 12, 2018.

At the time he was hooked on crack cocaine, which he admitted in his own 2021 memoir.

Last December, Joe Biden pardoned his troubled son, dismissing both the gun case and a separate tax case — and shielding him from future prosecution for any potential crimes committed between Jan. 1, 2014, and Dec. 1, 2024 — before Hunter was due to be sentenced.

The review by the Supreme Court is an opportunity to clarify a grey area in gun laws that have stumped lower courts since the landmark 2022 Supreme Court ruling on New York gun regulations.

At the time the high court said lower courts should look to 18th and 19th century case law to review gun cases.
