First son Hunter Biden pleaded not guilty Tuesday morning at a Delaware federal courthouse to weapons and false statement charges after a plea deal collapsed over the summer.

Hunter, 53, entered the not-guilty plea for all three counts, including making a false statement in purchasing a firearm, making a false statement related to information required to be kept by a federal firearms licensed dealer, and unlawfully possessing a firearm while addicted to a controlled substance.

The first son, who walked into the Wilmington federal courthouse to face Magistrate Judge Christopher Burke sporting a jailhouse-style buzz cut, was charged last month by special counsel David Weiss with lying about being addicted to crack cocaine when he bought a gun nearly five years ago.

The first son cleared his drug test shortly after arriving at the courthouse and departed after entering his plea around 10:25 a.m. Burke set a Nov. 3 deadline for any pre-trial motions in the case.

The indictment alleges Hunter purchased a Colt Cobra revolver when he was abusing crack cocaine in 2018, which he later admitted to in his 2021 memoir “Beautiful Things.”

His probation agreement requires him to seek active employment, share in writing any plans for international travel, not possess a firearm, not abuse alcohol or drugs, and submit to drug tests as well as substance abuse counseling if asked by his probation officer from the Central District of California, according to Tuesday’s court filings

The felony charges carry a top sentence of 25 years in prison and up to $750,000 in fines, though that severe penalty would be unlikely to be handed down to the non-violent, first-time offender.

Hunter was made to show up in person after a judge declined his request to be arraigned over Zoom from his California home.

President Biden’s son was brought up on the felonies after walking away from a plea deal this summer that would have granted him probation for failing to pay more than $2 million in taxes.

Under that agreement, Hunter would have admitted to the gun offenses, but the deal fell apart around the time a pair of IRS whistleblowers sounded the alarm on what they called a wide-ranging coverup in the feds’ investigation.

US District Judge Maryellen Noreika also got federal prosecutors to admit that a provision in the plea deal appeared to grant the first son unprecedented immunity for past crimes.

The prosecutors answered that there was no such assurance from them, prompting defense attorney Chris Clark to declare the plea deal “null and void.”

IRS Special Supervisory Agent Gary Shapley and IRS Special Agent Joseph Ziegler said their probe was “slow-walked” and blocked investigators from taking certain steps — or asking questions that could lead to President Biden.

The mishandled probe may have allowed Hunter to elude more serious charges of money laundering, illegal foreign lobbying, and sex trafficking, according to evidence compiled by House Republicans and found on the first son’s abandoned laptop.

In a series of disclosures made to the House Ways and Means Committee, Shapley and Ziegler alleged their investigation began in November 2018 by looking into a “foreign-based amateur online pornography platform.”

They found that Hunter and his business associates received roughly $17.3 million through deals with foreign entities in Ukraine, Romania, and China between 2014 and 2019 — with the first son scooping $8.3 million.

In one shocking exchange, a July 30, 2017, WhatsApp message revealed by the investigators shows Hunter Biden threatened a Chinese government-linked associate by saying he was “sitting here with my father” and would “forever hold a grudge” if their business deal was not fulfilled.

Within 10 days, payments that eventually amounted to more than $4.8 million began to flow to accounts linked to Hunter and James Biden, according to past reports.

The IRS tax investigators also alleged that Weiss in an Oct. 7, 2022, meeting said he was “not the deciding person” and had been blocked from pursuing charges outside of Delaware by US Attorneys Matthew Graves in Washington, DC, and E. Martin Estrada in Los Angeles.

Other IRS officials have since affirmed key details from that meeting, while FBI officials who were present have testified that they were unable to confirm Shapley’s account, which the IRS agent took handwritten notes about at the time.

The House Oversight Committee separately obtained thousands of bank records — and subpoenaed for even more — that found $24 million was transferred to Biden-linked accounts from foreign companies and foreign nationals in Ukraine, Russia, Kazakhstan, Romania, and China between 2014 and 2019.

Former Hunter business partner Devon Archer also testified to the House panel that the first son put his father on speakerphone at least 20 times with business associates in an effort to promote the Biden “brand.”

Former President appointed Weiss as Delaware’s top prosecutor in 2017 at the recommendation of the state’s Democratic senators Chris Coons and Tom Carper after having served as an acting US attorney under President Barack Obama.

Attorney General Merrick Garland has provided conflicting testimony to Congress about the scope of Weiss’ authority, maintaining the Delaware prosecutor had “full authority” to bring charges against Hunter while also saying US attorneys in other jurisdictions “could refuse to partner” with him.

On Aug. 11, Garland elevated Weiss to special counsel status after Hunter’s plea agreement imploded and the Delaware prosecutor’s impartiality was questioned by congressional Republicans.

Weiss is expected soon to testify to the House Judiciary Committee, along with Graves, Estrada, and Acting Deputy Assistant Attorney General Stuart Goldberg, who all have transcribed interviews scheduled this month.

The case is moving forward as House Republicans launched an impeachment inquiry into President Biden, alleging that the Democrat benefitted from his son’s overseas lobbying activities when he served as vice president.

White House Counsel’s Office spokesman Ian Sams said last week that Republicans had “no evidence of wrongdoing” on the part of the president and were using “discredited personal attacks on him and his family.”

Hunter’s defense attorney Abbe Lowell has also said that Hunter Biden was not in business with his father and any discussions in the presence of the first son’s business associates were “small talk.”
