An illegal migrant allegedly committed a heinous sex crime in Boston after apparently cutting off his ICE tracking device — yet was still freed by a judge, even over US immigration officials’ protests.

The accused sicko was finally tracked down independently by ICE in the “sanctuary city” last month and is being held in custody based on his rogue immigration status.

“Today, another victim in Massachusetts no longer needs to fear their predator,” said ICE Enforcement and Removal Operations Boston Acting Chief Patricia Hyde in a statement.

The alleged pervert Dominican migrant, Emilio Jose Pena-Casilla, 46, had illegally entered the US at the Eagle Pass, Texas, border in January 2023, ICE said. 

He was quickly nabbed but claimed asylum, prompting border agents to fit him with a tracking device and free him under Biden administration rules, while his case theoretically wound its way through the US court system.

But within a month, Casilla was deemed “terminated” from the migrant monitoring program, called “Alternatives to Detention.” The “terminated” term typically means the migrant removed their tracking device and is now illegally roaming around the US without any kind of monitoring.

Then more than a year later, in July, he was busted in Boston for the alleged rape, kidnapping and indecent assault and battery of a victim 14 years or older and intimidating a witness, juror, police or court official, ICE said in a recent statement.

He was arraigned on the serious raps, leading ICE to issue a detainer with the local jail to take him into federal custody, ICE said.

But Boston is a so-called sanctuary city that limits local officials’ cooperation with federal immigration efforts — and recently passed a resolution to further restrict police from keeping migrants in custody pending deportation, according to Fox News.  

The situation led local authorities to ignore ICE’s detainer request and release Casilla the next day on bail with another ankle monitor.

The suspect was finally nabbed by ICE itself on Dec. 17 over immigration raps .Hyde noted that Casilla is accused of committing “very serious offenses against a Massachusetts resident.”

She pledged to continue to arrest and move to deport migrants in similar situations.President-elect Donald Trump’s incoming border czar, Tom Homan, has promised to crack down on “sanctuary” leaders with potential lawsuits and threats to withhold federal funding.Homan has also vowed to flood sanctuary cities with more ICE agents who will wait for migrant offenders to get out of jail.

“If they’re not willing to do it, then get out of the way — we’re coming,” Homan has told The Post of “sanctuary” officials.
