BOSTON — The judge presiding over a rape case against a former Massachusetts Institute of Technology basketball player says she is “baffled” by a proposed plea deal that includes no prison time.

Samson Donick, of Tiburon, California, was accused of sexually assaulting a sleeping woman in 2015 after he entered her Boston University dorm room looking for someone else.

Prosecutors said Monday that they struck a deal with Donick’s attorneys after the woman decided not to testify at trial. The Boston Globe reports the deal would let Donick avoid a formal conviction but would require him to serve five years’ probation.

A defense attorney says Donick would admit touching the woman “in an offensive way” without consent. The judge says she might require a more detailed admission before approving the deal.
