Justice Brett Kavanaugh has tested positive for COVID-19, the Supreme Court said Friday.

The 56-year-old, who has been fully vaccinated since January, was showing no symptoms when his positive test came back Thursday night, the court said in a statement.

Kavanaugh had the routine test ahead of Justice Amy Coney Barrett’s investiture ceremony Friday morning where she took her oath of office as the court’s newest member.

“Per current court testing protocols, all of the Justices were tested Monday morning prior to conference, and all tested negative, including Justice Kavanaugh,” the court said.

“Justice Kavanaugh’s wife and daughters are also fully vaccinated, and they tested negative on Thursday.”

Kavanaugh and his wife Ashley did not attend Barrett’s investiture as “a precaution”, the court said.

His positive test comes just three days before the Supreme Court’s next term is due to begin and they resume in-person arguments for the first time amid the COVID-19 pandemic.

All of the other justices were present inside the courtroom on Friday for Barrett’s swearing in.

Barrett was joined outside the court by Chief Justice John Roberts following the investiture ceremony.

They were pictured walking down the steps of the high court together before Barrett was greeted by her husband, Jesse M. Barrett.
