The parents of missing California college student Kristin Smart are suing the father of the man charged with her murder for his alleged role in hiding her body, it was revealed Friday.

Ruben Flores, 80 — dad of murder suspect Paul Flores, 44 — caused Stan and Denise Smart “severe emotional distress” when he allegedly dug up Smart’s remains under his deck in Arroyo Grande, Calif., according to a lawsuit cited by ABC News.

The elder Flores allegedly worked with two unnamed people “under cover of darkness” to move Smart’s body to an undisclosed location in San Luis Obispo County in February 2020, the suit states.

He’s accused of moving her remains to help his son get away with the alleged murder “should another search warrant be executed,” according to the lawsuit, filed Thursday in San Luis Obispo County Superior Court.

But hiding the body denied Smart — who is presumed dead after disappearing in 1996 — and her parents a proper burial, the suit claims.

It prevented her from being “laid to rest in a place of honor and dignity, as opposed to the present circumstances where their daughter’s body was discarded like human garbage,” the court papers state. “[Ruben Flores] committed acts of such viciousness, depravity and cruelty as to, by their definition, cause severe emotional distress.”

Flores allegedly moved Smart’s remains “to cover up the complicity of Paul Flores in the death of Kristin Smart… should another search warrant be executed,” according to the suit.

The sheriff’s office conducted a search of Ruben Flores’ property in March, roughly a month before his son was arrested. Smart’s remains still have not been found.

Paul Flores is accused of killing Smart during an attempted rape at California Polytechnic State University, where she was last seen walking home from a party. 

Ruben Flores was charged as an accessory to murder in connection with Smart’s disappearance. Both men have pleaded not guilty.

Smart’s parents are seeking unspecified damages, according to court documents.
