State Attorney General Letitia James’ attorney blasted the Trump administration Thursday for using “cherry-picked” information against her in a federal criminal referral — although she admitted to “mistakenly” listing a Virginia home as the Democrat’s primary residence.

In a fiery, five-page letter to US Attorney General Pam Bondi, James’ lawyer Abbe David Lowell picked apart the accusations that James committed mortgage fraud, calling the referral a meritless, hypocritical salvo in President Trump’s “revenge tour” against the prosecutor.

Federal Housing Finance Agency Director William Pulte’s bombshell criminal referral was based off shoddy media reports and a selective reading of public records, Lowell argued.

Among the allegations outlined in Pulte’s referral were that James listed a Virginia home more than 300 miles from her New York City office as her “principal residence.

That document cited a power of attorney document from 2023 signed by the AG authorizing the purchase of the property, in which she attested “I hereby declare I intend to occupy this property as my principal residence.”

However, Lowell chalked this up to a clerical error, and accused Pulte of selectively including it to bolster his accusations.

“Director Pulte cherry-picked an August 17, 2023 power of attorney that mistakenly stated the property to be Ms. James’ principal residence and at the same time absolutely ignored her very clear and all caps statement two weeks earlier to the mortgage loan broker that ‘[t]his property WILL NOT be my primary residence,’” the letter said.

Another accusation Pulte included in his referral letter was that James, whose salary is $220,000, misrepresented the number of apartments in a building she has owned in Brooklyn since 2001. Pulte claimed James said the building only had four units, but pointed out that the NYC Department of Buildings records says it has five.

It’s an important distinction because buildings with four units or fewer qualify for mortgages with more favorable terms.

However Lowell also sought to punch holes in those claims in his blistering letter.

“Director Pulte points to a 24-year-old certificate of occupancy listing the property as having five units, despite that the property has functioned as a four-unit residence for the past 24 years since Ms. James bought it,” Lowell wrote.

“In fact, a document he is well aware of, the August 23, 2011 Home Affordable Modification Program application, confirms it as being a four-unit property.”

The letter further contends the accusations are Trump’s promised “retribution” against his political enemies.

James in particular has been the subject of Trump’s ire after she marshaled a civil fraud trial against him and his Trump Organization that ended with a $454 million judgment.

“Look at the entire file of each event, the haste in which one document has one line filled out in error, and the clear fact that, with the exception of attending school, Attorney General James has only lived in Brooklyn, and the ‘criminal referral’ becomes three pages of stale, threadbare allegations with no reason to proceed other than they are ‘[b]ased on media reports’ and are the next salvo in President Trump’s revenge tour against Attorney General James,” Lowell wrote in the letter.

Lowell was retained by the attorney general’s office rather than James in her personal capacity, according to a Times Union report, which means New York taxpayers will eventually foot the bill for his services. 

The outlet states James’ office said that decision was based on the office’s contention that the motivation behind the criminal referral is due to a vendetta Trump holds against the attorney general for bringing the civil case against him last year.

Lowell was one of Hunter Biden’s top lawyers in the scandal-scarred first son’s special counsel probe, which culminated in charges for gun and tax crimes.
