Sen. Lindsey Graham killed off Supreme Court Justice Samuel Alito on Tuesday.

“Justice Alito passed away in February,” the South Carolina Republican said as he questioned Supreme Court nominee Neil Gorsuch at his confirmation hearing.

Alito, of course, is very much alive.

Graham meant Justice Antonin Scalia, who died on Feb. 13, 2016, and whose seat Gorsuch has been nominated to fill.

Graham soon realized his error and corrected the record.

“Bad news, bad mistake,” Graham told the Senate Judiciary Committee.

The gaffe came as Graham addressed Democrats’ concern about how Senate Republicans held up the process for former President Obama’s nomination of Judge Merrick Garland to the Supreme Court.
