SOMERVILLE, N.J. — A New Jersey man has been sentenced to five years in prison on charges stemming from the death of his newborn grandson in 2005.

Prosecutors say Patrick McCabe Sr. refused to call 911 after his teenage daughter gave birth on the toilet — with the infant partially submerged — at the family’s North Plainfield home in December 2005.

After nearly two hours, the infant was taken to a hospital, where it later died.

McCabe and his wife, Deborah — who were unaware their daughter was pregnant — initially were indicted on aggravated manslaughter charges. But that was upgraded to murder in February after Somerset County prosecutors presented additional information to another grand jury.

Patrick McCabe then agreed to plead guilty to manslaughter, and the charges against his wife were dismissed. Under the sentence imposed Friday, he must serve 85 percent of his sentence before becoming eligible for parole.
