Barely a day has passed since Wednesday’s LIRR crash, but the first victim has already started the process of suing the MTA, according to court papers.

Passenger Clifford Jones, who was on the train from Far Rockaway when it crashed in Brooklyn filed a notice of claim saying he plans to sue the agency for $5 million, according to paperwork filed in Brooklyn Supreme Court.

The commuter train, which was traveling at twice the speed limit, derailed at the Atlantic Terminal at 8:20 a.m., leaving at least 104 people injured.

Jones, 48, who lives in Queens Village, suffered injuries to his right knee, right shoulder, neck and back, as well as emotional trauma, said his attorney Sanford Rubenstein.

“The NTSB must find the cause of this crash so disasters such as this won’t happen again,” said Rubenstein.

MTA officials declined to comment, saying that it does not discuss litigation.
