An appeals court today upheld the life sentences imposed on a mob kingpin and one of his henchmen for orchestrating a hit on a rival in their Mafia clan.

Former acting Colombo crime-family boss Alphonse “Allie Boy” Persico and John “Jackie” DeRoss wanted their 2007 convictions overturned because the FBI found the body of slain underboss William “Wild Bill” Cutolo buried on Long Island after prosecutors said it had been dumped at sea.

But the ruling from the U.S. Second Circuit Court of Appeals said there was “no likelihood that innocent men have been convicted, no injustice in the guilty verdicts and no error or abuse of discretion in the district court’s conclusion that the discovery of Cutolo’s body did not warrant the granting of a new trial.”

According to the feds, Persico ordered Cutolo whacked in 1999 to prevent him from staging a coup while Persico served time for weapons possession.

Persico, 57, is the son of imprisoned Colombo boss Carmine “The Snake” Persico, who has reportedly become pals behind bars with Ponzi king Bernard Madoff.

Lawyers for the younger Persico and DeRoss, 73, didn’t immediately return requests for comment.
