A distraught woman who flung her 19-month-old daughter into the frigid Hudson River last May as revenge against her husband may be released to attend an outpatient psychiatric program, a judge said yesterday.
Manhattan Supreme Court Justice Lewis Bart Stone ruled that Devi Silvia, 33, can go home to her husband and get daylong counseling at Elmhurst Hospital while awaiting the disposition of attempted-murder charges. Her daughter, Jessica, survived.
The judge also wondered whether Silvia, who jumped into the water in a failed suicide attempt, should even be tried.
“What she did was obviously an extremely disturbing matter,” Stone said. “But [is this] a case for criminal punishment or medical treatment?”
