Fat chance.
An appeals court upheld “Fat Nick” Minucci’s hate-crime convictions for attacking a black man in Howard Beach with a baseball bat in 2005.
Minucci, then 20, appealed in 2006, arguing that people under 30 were unlawfully excluded from the jury and that Queens Supreme Court Justice Richard Buchter refused to allow a character witness who would have testified that Minucci wasn’t a racist.
Sentenced to 15 years in prison, Minucci will be eligible for parole in 2019.
