A newly elected Queens assemblyman will introduce legislation making it a felony to assault a cabby, following a vicious New Year’s Day attack on a hack in Brooklyn.

The legislation would be similar to existing laws that deem attacks on nurses and transit workers an automatic felony, said Queens Democrat Ron Kim.

Kim made the announcement in front of Kings County Hospital, where cabby Key Chun Kim remains in a coma from injuries that he sustained on Jan. 1.

Kim — not related to the pol — was allegedly attacked by passenger Andrew McElroy, who had tried walking off without paying the fare, cops said.

Kim confronted him, and McElroy allegedly responded by fracturing the victim’s skull.

McElroy was charged with attempted murder and assault in the first degree.
