The alleged victim in the “rape cops” trial might have blacked out on what happened — but she might not have been passed out, an NYPD toxicology expert acknowledged yesterday.
It’s possible the woman could “walk and talk” but not remember anything else, admitted Michael McGee under cross-examination by a defense lawyer.
The woman maintains she was only semi-conscious when she woke up with Officer Kenneth Moreno on top of her after a night of guzzling vodka in 2008.
But the defense is trying to portray the alleged victim as unreliable, because she might think she was passed out when she actually wasn’t — and, therefore, could have given consent.
Moreno, 43, and his accused lookout, Officer Franklin Mata, 27, are charged with rape.
