Accused “cannibal cop” Gilberto Valle says he may have to take the witness stand if an FBI agent isn’t cross-examined about “substantially exculpatory statements” Valle claims he made while under interrogation after his arrest.

In a letter to the judge, Valle’s lead lawyer complained that prosecutors “cherry-picked” only damaging testimony from Agent Anthony Foto from the nearly four hours that Valle blabbed to him after getting busted last year.

But public defender Julia Gatto insisted that Foto “opened the door” to cross-examination on several key issues, including whether Valle said his admitted interest in cannibalism was “real or fantasy.”

Unless Foto is forced to also give potentially “favorable testimony” for Valle when he returns to the stand tomorrow, it “could force Mr. Valle to testify to rebut Mr. Foto’s false statements,” Gatto wrote.
