A driver charged with criminally negligent homicide was acquitted yesterday in the death of a bicyclist in Brooklyn last year, after a surveillance video helped convince the jury of his innocence.

Michael Oxley slammed into John McDonaugh, 18, at Flatbush Avenue and Beverly Road in April 2010.

A video from outside a restaurant seemed to sway the jurors that Oxley had the light, said defense attorney Gary Farrell.

But the Brooklyn Supreme Court jury convicted him of speeding and driving with a suspended license.

Justice Raymond Guzman sentenced Oxley to 10 days in jail.
