A construction company and its site supervisor both charged in the worksite death of a hardhat crushed by a collapsing wall are blaming each other for the accident, court papers show.

Supervisor Alfonso Prestia, 55, argued that the 2015 death of Carlos Moncayo was Harco’s fault because the company wouldn’t let him fire the problematic foreman who allegedly created the unsafe conditions.

But Harco said it intended to “challenge the claim, as well as Mr Prestia’s credibility, as part of its defense.”

In the jointly filed motion, the two defendants asked Justice Thomas Farber to try them separately as their defenses are “antagonistic and irreconcilable.”

Farber granted the motion Tuesday over the objection of prosecutors in Manhattan Supreme Court.

Prestia, foreman Wilmer Cueva and their respective companies, Harco and Sky Materials Corp., face charges of manslaughter, criminally negligent homicide and reckless endangerment for the April 6 accident in the Meatpacking District.

Prestia and Cueva allegedly refused to shut down the Ninth Avenue site even after an inspector noticed that a 13-foot-deep pit wasn’t properly re-enforced and warned them that no worker should be allowed in the trench, prosecutors charge.

Harco’s trial, the first of the defendants, is set to begin May 16.
