The NYPD is engaging in a game of tug-of-war over a homeless man’s makeshift house disguised as a dumpster in Soho, taking it away for the second time in two days.
The secret home, which was created by two documentary filmmakers to draw attention to homelessness, was removed on Saturday but given back to them on Sunday, without a summons.
After repeated coverage by The Post, cops decided to take the structure away again Monday afternoon and issued a summons to Shane Duffy, the creator of the contraption, for “storing removable property on a public sidewalk.”
Duffy told The Post the summons was going to go to Daniel Cummings, the homeless man who’d taken up residence in the box, but Duffy took it himself because he didn’t want Cummings to have to worry about it.
Police sources said Duffy was advised Sunday that the box violated city code because it was on a city sidewalk.
Police on the scene said Duffy was told Sunday to not bring the box back, but he did anyway.
Duffy insists the box wasn’t going to permanently stay there and they only had it back on the corner for a short time to do some filming.
The box has been taken to the 1st Precinct and Duffy will be allowed to retrieve a small bag of clothing from it that has Cummings’ property in it, the cops said.
