One of the young female students sexually assaulted by her teacher at Brooklyn Tech lost her bid to sue the city Department of Education in state court over the disturbing relationship, according to new court papers.

The Second Department appellate decision, issued Thursday, found that the teen, identified only as N.N., missed deadlines to file a notice of claim.

Math and physics teacher Sean Shaynak’s relationship with the student began in 2012 when she was about 13 years old, and lasted until 2014, court papers say.

N.N., who will be 19 years old in September, missed the 90-day deadline to file a notice of claim, as well as another cutoff date to file a late notice of claim.

The new decision does not impact N.N.’s lawsuit that is currently pending in Brooklyn federal court.

She and four other victims are suing under federal statute Title IX, which protects students against sexual harassment in school.

Shaynak is serving five years in prison for preying on seven teen students.
