A teen with a history of running away was assaulted by a livery driver after repeatedly fleeing the custody of the Administration for Children’s Services, her father charges in a lawsuit.

Roberto Gomez said he sought ACS’ help with his 15-year-old last year and the agency placed the girl in its First Avenue facility in Manhattan.

But the Nicholas Scoppetta Children’s Center, a kid’s shelter, isn’t a locked or secure facility, and the girl ran away a few more times before she was assaulted by a livery driver in the Bronx in July, Gomez claims in a Manhattan Supreme Court lawsuit against the city and ACS.

The city will investigate the allegations and review the complaint, the Law Department said.
