Marine veteran Daniel Penny, 26, is on trial for manslaughter in NYC after placing homeless man Jordan Neely in a deadly chokehold on the subway in May 2023.

On Tuesday, jurors watched close-up, frame-by-frame footage of the fatal chokehold — which prosecutors have called the “most crucial piece of evidence” they will see.

The edited version of video shot by a journalist appears to show Penny increasing the pressure of his chokehold as Neely tries to escape.

Earlier in the trial, several witnesses who were on the crowded uptown train described being terrified by an unhinged Neely as he threatened and lunged at people, with one veteran straphanger saying she was “scared s–tless” and told cops at the scene that Neely “scared the living daylights out of everybody” before Penny intervened.
