The death of Brooklyn dad Akai Gurley, who was shot and killed by a rookie cop in a pitch-black stairwell, has been ruled a homicide, the Medical Examiner’s office announced.

Gurley, 28, died after suffering a gunshot wound to his torso.

“His death resulted in whole from actions of another person, not from natural causes like disease,” the Medical Examiner’s office said in a statement.

“The classification does not imply any statement about intent or culpability, and as with all classifications made by OCME, the evaluation of legal implications of this classification is a function of the District Attorney and the criminal justice system.”

Officer Peter Liang, 27, is still on modified duty after firing off a single round into a darkened stairwell Thursday night at East New York’s Louis Pink Houses, killing Gurley, who was standing on the floor below.

Liang – who had been on the force for less than 16 months – breached police protocol when he rested his finger on his drawn gun while performing a vertical patrol at the public housing project, The Post reported.

Brooklyn District Attorney Ken Thompson is investigating the fatal shooting, which Police Commissioner Bill Bratton called a tragic “accident” at a Friday press conference.
