Former Congressman Vito Fossella can add tax cheat to his rap sheet.

The state Department of Taxation has a warrant against the Staten Island Republican’s 2008 re-election campaign because it did not pay withholding taxes from its employees’ paychecks, records show.

His campaign owes the state $3,298.92 for failing to pay a $980 tax bill in April 2009, a state Tax Department spokesman said. The campaign had about $58,015 cash on hand in 2010 according to federal election filings.

Fossella did not return a message.

Fossella resigned from office in May 2008 following a drunken-driving bust in Virginia, which led to the revelation he had fathered a child in an extramarital affair and maintained a secret family.

He has since reconciled with his first family and landed a consultant gig with former Sen. Al D’Amato’s firm Park Strategies.
