It wasn’t a ruff rap.

Dog owner Eric Swanson took a dismissal deal for ripping up a small fence erected by an eyebrow spa to keep his precious pooch Scooby from peeing on a tree outside their storefront.

If Swanson, 48, stays out of trouble for six months, prosecutors will dismiss and seal the one count of criminal mischief against him.

A judge approved the deal Tuesday, and Swanson didn’t have to admit wrongdoing or show up in Manhattan Criminal Court.

“We didn’t think the court needed a dog and pony show,” said defense lawyer Ron Kuby of his client signing off on the deal by affidavit.

Swanson was collared after Tammy’s Eyebrow Spa on Madison Avenue called the cops on him.

He was captured on surveillance footage at 9:41 p.m. Nov. 3 yanking apart the 1-foot-high white picket fence encircling a tree near E. 96th Street and tossing it in the garbage, court papers allege.

Scooby, a Great Dane mix, had favored the tree as his preferred lavatory for years. But then the eyebrow salon moved in and constructed the fence to discourage the 11-year-old rescue dog’s potty habit.

“After about two months of enduring the fence, my dog stepping over it and tripping over it on his way out, I pulled it up,” admitted Swanson in an earlier interview. “It’s the easiest place for my dog to pee.”

The city has since chopped down the tree.
